1. Acceptance of Terms

By accessing and using HostRadical's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

HostRadical provides web hosting, cloud hosting, VPS hosting, dedicated servers, and related services. Our services are subject to the terms outlined in this agreement and any additional terms specified in your service plan.

3. Account Registration and Security

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person or legal entity may not maintain more than one account without prior approval

4. Payment Terms

• All fees are due in advance and are non-refundable unless otherwise stated
• We offer monthly and annual billing cycles with discounts for longer commitments
• Accounts are subject to suspension for non-payment after 7 days past due
• We reserve the right to change our fees with 30 days advance notice
• All payments are processed securely through our PCI DSS compliant payment system

5. Acceptable Use Policy

You agree not to use our services for:

• Illegal activities or content that violates applicable laws
• Spam, bulk email, or unsolicited commercial communications
• Malware, viruses, or any malicious code
• Adult content involving minors or non-consensual material
• Intellectual property infringement
• Activities that could harm our network or other customers
• Cryptocurrency mining without explicit permission

6. Service Level Agreement

We strive to maintain 99.9% uptime for all our services. In the event of downtime exceeding our SLA:

• Monthly downtime of 0.1% - 1%: 5% account credit
• Monthly downtime of 1% - 2%: 10% account credit
• Monthly downtime exceeding 2%: 25% account credit
• Credits must be requested within 30 days of the incident

7. Data and Backups

• We perform daily backups for disaster recovery purposes
• Backups are retained for 30 days and may be used for restoration
• You are ultimately responsible for your own data backup strategy
• We recommend maintaining independent backups of critical data
• Data restoration services may incur additional charges

8. Limitation of Liability

HostRadical's liability is limited to the amount paid for the service during the month in which the issue occurred. We are not liable for indirect, incidental, or consequential damages including but not limited to:

• Loss of profits, revenue, or business opportunities
• Data loss or corruption
• Third-party claims or damages
• Service interruptions beyond our control

9. Account Termination

Either party may terminate the service agreement:

• Customer termination: 30 days written notice required
• HostRadical termination: For violation of terms or non-payment
• Data will be retained for 30 days after termination for retrieval
• No refunds will be provided for early termination by customer

10. Intellectual Property

• You retain ownership of content uploaded to our services
• You grant us a license to host and deliver your content
• HostRadical trademarks and proprietary technology remain our property
• You must respect third-party intellectual property rights

11. Privacy and Data Protection

Your privacy is important to us. Our data handling practices are detailed in our Privacy Policy, which is incorporated by reference into these terms.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via:

• Email notification to all active accounts
• Notice posted on our website
• Update in your account dashboard
• 30 days advance notice for material changes

13. Governing Law

These terms are governed by the laws of the State of California, United States. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
